02Acceptance of Terms

By downloading, installing, accessing, or using ModWorks, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use ModWorks. If you use ModWorks on behalf of an organization, you represent that you are authorized to bind that organization.

03Description of Service

ModWorks is a desktop toolkit for GTA V and FiveM file workflows. Features may include archive browsing, model and texture preview/editing, audio workflows, file conversion, and utility tooling. Feature availability depends on your plan tier, account status, and release channel.

04Account and Authentication

Accounts are created through Discord OAuth. You are responsible for your account credentials, Discord account security, and all activity under your account. Do not share tokens or attempt to access other accounts. Account sharing, token abuse, and attempts to bypass restrictions may result in suspension or termination.

05Acceptable Use

You agree not to: (1) use ModWorks for unlawful activity; (2) distribute malware, malicious payloads, or intentionally corrupted files; (3) circumvent bans, licensing, telemetry, feature gates, or security controls; (4) reverse engineer, decompile, or disassemble ModWorks except where such restriction is prohibited by law; (5) use ModWorks to violate third-party platform rules, including GTA Online and publisher policies.

06Subscriptions and Billing

Paid subscriptions (including Standard and Premium tiers) are billed by Stripe and may renew automatically until canceled. You are responsible for all applicable taxes and fees. You can manage or cancel subscriptions through your billing portal. Except where required by law, fees are non-refundable and refunds are discretionary. We may change pricing or plan features with reasonable notice.

07Intellectual Property

ModWorks, its code, branding, and related materials are proprietary and protected by intellectual property law. We grant you a limited, revocable, non-exclusive, non-transferable license to use ModWorks in accordance with these terms and your active plan. You may not redistribute, resell, sublicense, or create unauthorized derivative commercial offerings based on ModWorks.

08Termination and Bans

We may suspend, limit, or terminate access at any time for violations, abuse, fraud, security risk, chargeback abuse, legal risk, or platform integrity concerns. Enforcement may use multiple identifiers (including account, device identifiers, and IP signals). On termination, your license ends immediately and you must stop using ModWorks.

09Third-Party Content and Services

ModWorks integrates with third-party services and ecosystems, including Discord and Stripe, and may process files related to GTA V and FiveM ecosystems. We are not affiliated with Rockstar Games, Take-Two Interactive, Cfx.re, FiveM, or any of their affiliates. Third-party terms and policies apply to your use of their services and platforms. All third-party trademarks, names, and logos are the property of their respective owners.

10Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless ModWorks and its operators from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (1) your use or misuse of ModWorks; (2) your content or files; (3) your violation of law, third-party rights, or these terms.

11Disclaimer of Warranties

ModWorks is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted service, error-free operation, compatibility with every environment, or preservation of game files, server files, or online account standing.

12Limitation of Liability

To the maximum extent permitted by law, ModWorks and its operators are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, corrupted files, service interruption, platform penalties, account actions, lost profits, or business interruption. Our aggregate liability for all claims arising from or related to ModWorks will not exceed the greater of: (1) amounts you paid to us in the 12 months before the event giving rise to liability; or (2) fifty U.S. dollars (USD $50).

13Dispute Resolution and Class Action Waiver

Before filing a formal claim, both parties agree to attempt good-faith informal resolution. If unresolved, disputes will be resolved by binding individual arbitration to the extent permitted by law, and not by jury trial or class action. You and we waive participation in class, consolidated, or representative actions. If arbitration terms are unenforceable in your jurisdiction, disputes will be resolved in competent courts of that jurisdiction on an individual basis.

14Changes to Terms

We may update these terms from time to time. Updated versions will be posted with a revised "Last Updated" date. Continued use after changes take effect constitutes acceptance of the updated terms.
